1. Acceptance of these terms
These terms are an agreement between you and [FITOX_ENTITY — registered legal name & address, Jordan] ("Fitox", "we", "us"). By creating an account or using the Fitox app or API, you agree to them. If you don't agree, please don't use Fitox. If you use Fitox on behalf of a store or business, you confirm you're authorized to accept these terms for it.
2. What Fitox does
Fitox is an AI virtual try-on service. You upload photos and measurements, we generate a personalized base model, and you can preview how garments might look on you. Try-on images and fit scores are AI-generated approximations — they're meant to help you visualize and choose sizes, not to be a perfect or guaranteed representation of the real product, fit, color, or fabric.
3. Your account
- You must be at least 16 years old to use Fitox.
- Provide accurate information and keep your login credentials secure. You're responsible for activity under your account.
- One account per person. Don't impersonate others or use someone else's identity.
4. Credits
Try-ons are powered by credits. Credits have no cash value, are not transferable, and (except where the law requires otherwise) are non-refundable. Free credits may reset on a schedule, and paid credits may be subject to the terms of the plan you buy. We may change credit pricing or allowances with reasonable notice.
5. Your content and photos
- You keep ownership of the photos and content you upload.
- You grant Fitox a limited license to store and process your content only to provide the service to you (for example, generating your base model and try-on results). We handle photos as described in our Privacy Policy.
- Only upload photos of yourself, and only upload garment images you have the right to use. Don't upload anyone else's photo without their consent, or any illegal, infringing, or offensive content.
6. Acceptable use
Don't:
- Abuse, overload, or attempt to disrupt the service, or generate try-ons in an automated or excessive way.
- Reverse-engineer, scrape, or resell the service, or attempt to access data that isn't yours.
- Use Fitox to create misleading, harmful, or infringing content.
We may limit, suspend, or terminate accounts that violate these rules or put the service or its users at risk.
7. Orders and stores
Fitox helps you discover products and build orders, but Fitox is not the seller. When you order, you're connected to the store (for example via WhatsApp), and the actual sale, payment, pricing, availability, shipping, returns, and customer service are between you and that store. Fitox is not responsible for a store's products, fulfillment, or conduct.
8. Intellectual property
Fitox and its software, design, and branding are owned by Fitox and protected by law. These terms don't give you any right to use the Fitox name or brand except to use the service as intended.
9. Service availability
We work to keep Fitox running well, but we provide it on an "as is" and "as available" basis. AI generation depends on third-party providers and may occasionally fail, be delayed, or produce imperfect results; when a generation fails, we aim not to charge you for it.
10. Disclaimers and limitation of liability
To the fullest extent permitted by law, Fitox makes no warranties about the accuracy of try-on images, fit scores, or size recommendations, and is not liable for indirect, incidental, or consequential damages, or for purchase decisions you make based on AI-generated results. Where liability can't be excluded, it is limited to the amount you paid Fitox in the 12 months before the claim.
11. Termination
You can stop using Fitox and delete your account at any time. We may suspend or end your access if you violate these terms or if we discontinue the service. Some provisions (like ownership, disclaimers, and liability limits) survive termination.
12. Changes to these terms
We may update these terms as the service evolves. We'll post the updated version here with a new date, and for significant changes we'll give notice in the app or by email. Continuing to use Fitox after changes means you accept them.
13. Governing law
These terms are governed by the laws of the Hashemite Kingdom of Jordan. Any disputes will be handled in the competent courts of Amman, Jordan, unless a mandatory consumer-protection law that applies to you gives you the right to bring a claim in your own country's courts.
